Hội nghị toàn thể
của Tổ chức Lao động Quốc tế,
Được Hội đồng quản
trị của Văn phòng Lao động Quốc tế triệu tập tại Geneva ngày 08 tháng 6 năm
1949, trong kỳ họp thứ ba mươi hai, và
Sau khi đã quyết
định chấp thuận một số đề nghị về việc áp dụng những nguyên tắc của quyền tổ
chức và thương lượng tập thể, vấn đề thứ tư trong chương trình nghị sự của kỳ
họp, và
Sau khi đã quyết
định rằng những đề nghị đó sẽ có hình thức là một Công ước quốc tế,
Thông qua ngày 01
tháng 07 năm 1949 Công ước dưới đây, gọi là Công ước về Áp dụng những nguyên
tắc của quyền tổ chức và thương lượng tập thể (1949):
Điều 1
1. Người lao động
phải được hưởng sự bảo vệ thích đáng trước những hành vi phân biệt đối xử chống
lại công đoàn trong việc làm của họ.
2. Sự bảo vệ đó phải
được áp dụng trước hết đối với những hành vi nhằm:
a) làm cho việc làm
của người lao động phụ thuộc vào điều kiện là người đó không được gia nhập công
đoàn hoặc phải từ bỏ tư cách đoàn viên công đoàn;
b) sa thải hoặc gây
tổn hại cho người lao động với lý do là đoàn viên công đoàn, hoặc tham gia các
hoạt động công đoàn ngoài giờ làm việc hoặc với sự đồng ý của người sử dụng lao
động trong giờ làm việc.
Điều 2
1. Các tổ chức của
người lao động và của người sử dụng lao động phải được hưởng sự bảo vệ thích
đáng chống lại mọi hành vi can thiệp của bên kia hoặc của những phái viên hay thành
viên của bên kia trong quá trình thành lập, hoạt động hoặc điều hành hoạt động
của mình.
2. Cụ thể, những
hành vi được coi là can thiệp theo định nghĩa của Điều này, là những hành vi
nhằm thúc đẩy việc thành lập tổ chức của người lao động do người sử dụng lao
động hay tổ chức của người sử dụng lao động chi phối, hoặc nhằm hỗ trợ tổ chức
của người lao động bằng tài chính hay bằng những biện pháp khác, với ý đồ đặt
các tổ chức đó dưới sự kiểm soát của người sử dụng lao động hay tổ chức của
người sử dụng lao động.
Điều 3
Nếu cần thiết, phải
thiết lập bộ máy phù hợp với điều kiện quốc gia, để đảm bảo cho việc tôn trọng
quyền tổ chức đã được xác định trong các điều trên.
Điều 4
Nếu cần thiết, phải
có những biện pháp phù hợp với điều kiện quốc gia để khuyến khích và xúc tiến
việc xây dựng và tận dụng đầy đủ các thể thức thương lượng tự nguyện giữa một
bên là người sử dụng lao động và các tổ chức của người sử dụng lao động với một
bên là các tổ chức của người lao động, nhằm quy định những điều khoản và điều kiện
về sử dụng lao động bằng thỏa ước lao động tập thể.
Điều 5
1. Mức độ áp dụng
những đảm bảo nêu trong Công ước này cho các lực lượng vũ trang và cảnh sát sẽ
do pháp luật hoặc quy định quốc gia quy định.
2. Theo những nguyên
tắc được đề cập đến trong Đoạn 8, Điều 19 của Điều lệ Tổ chức Lao động Quốc tế,
việc một Thành viên phê chuẩn Công ước này sẽ không được coi là làm ảnh hưởng
tới mọi đạo luật, mọi phán quyết, mọi tập quán hoặc mọi thỏa thuận hiện có mà
theo đó, các thành viên lực lượng vũ trang, cảnh sát được hưởng quyền được bảo
đảm trong Công ước này.
Điều 6
Công ước này không
điều chỉnh vị trí của các công chức tham gia quản lý nhà nước và bằng bất kỳ
cách nào cũng không thể giải thích là làm phương hại đến quyền hoặc địa vị của
họ.
Điều 7
Việc phê chuẩn chính
thức Công ước này phải được đăng ký với Tổng Giám đốc Văn phòng Lao động Quốc
tế.
Điều 8
1. Công ước này chỉ
ràng buộc những Thành viên của Tổ chức Lao động Quốc tế đã đăng ký việc phê
chuẩn của mình với Tổng Giám đốc Văn phòng Lao động Quốc tế.
2. Công ước này sẽ
bắt đầu có hiệu lực sau 12 tháng kể từ ngày hai Thành viên đã đăng ký việc phê
chuẩn của mình với Tổng Giám đốc.
3. Sau đó, Công ước
này sẽ bắt đầu có hiệu lực đối với bất kỳ Thành viên nào sau 12 tháng kể từ
ngày việc phê chuẩn của Thành viên đó đã đăng ký với Tổng Giám đốc.
Điều 9
1. Các tuyên bố gửi
cho Tổng Giám đốc Văn phòng Lao động Quốc tế theo khoản 2 Điều 35 của Điều lệ
của Tổ chức Lao động Quốc tế phải chỉ rõ:
a) các vùng lãnh thổ
mà Thành viên đó cam kết sẽ áp dụng toàn bộ các quy định của Công ước này mà
không sửa đổi;
b) các vùng lãnh thổ
mà Thành viên đó cam kết sẽ áp dụng những quy định của Công ước này với những
sửa đổi và chi tiết những sửa đổi đó;
c) các vùng lãnh thổ
không áp dụng Công ước này và trong trường hợp đó, lý do không áp dụng;
d) các vùng lãnh thổ
mà Thành viên đó còn bảo lưu quyết định của mình.
2. Những cam kết nêu
trong mục (a) và (b) khoản 1 của Điều này được coi là một phần không thể thiếu
trong việc phê chuẩn và có hiệu lực cùng với việc phê chuẩn.
3. Mọi Thành viên có
thể hủy bỏ toàn bộ hoặc một phần mọi quyết định bảo lưu của mình được đưa ra
trong tuyên bố ban đầu của nó theo mục (b), (c) hoặc (d) khoản 1 Điều này tại
bất cứ thời điểm nào bằng một tuyên bố khác sau đó.
4. Mọi Thành viên có
thể thông báo cho Tổng Giám đốc bằng một tuyên bố sửa đổi bất cứ điều khoản nào
trong tuyên bố trước đó và ghi rõ quan điểm hiện nay về những vùng lãnh thổ mà
Thành viên đó xác định, vào bất cứ thời điểm nào mà Công ước này bị bãi ước
theo quy định tại Điều 11.
Điều 10
1. Các tuyên bố gửi
cho Tổng giám đốc Văn phòng Lao động Quốc tế theo khoản 4 hoặc 5 Điều 35 của
Điều lệ của Tổ chức Lao động Quốc tế phải chỉ rõ liệu các điều khoản của Công
ước có được áp dụng trong vùng lãnh thổ có liên quan mà không sửa đổi hay có sửa
đổi; khi tuyên bố chỉ ra rằng các điều khoản của Công ước sẽ được áp dụng có
sửa đổi, tuyên bố phải nêu chi tiết những sửa đổi đó.
2. Một Thành viên,
nhiều Thành viên hoặc cơ quan quốc tế có liên quan có thể từ bỏ toàn bộ hoặc
một phần quyền áp dụng bất cứ sửa đổi nào được nêu trong tuyên bố trước đây vào
bất cứ thời điểm nào bằng một tuyên bố mới.
3. Một Thành viên,
nhiều Thành viên hoặc cơ quan quốc tế có liên quan có thể thông báo với Tổng
Giám đốc bằng một tuyên bố sửa đổi bất cứ điều khoản nào trong tuyên bố trước
đó và ghi rõ quan điểm hiện nay về việc áp dụng Công ước, vào bất cứ thời điểm
nào mà Công ước này bị bãi ước theo quy định tại Điều 11.
Điều 11
1. Thành viên đã phê
chuẩn Công ước này có thể bãi ước sau khi kết thúc thời hạn 10 năm kể từ ngày
Công ước bắt đầu có hiệu lực, bằng một văn bản đăng ký việc bãi ước này cho
Tổng Giám đốc Văn phòng Lao động Quốc tế. Việc bãi ước này chỉ có hiệu lực sau
một năm kể từ ngày đã đăng ký với Tổng Giám đốc.
2. Mỗi Thành viên đã
phê chuẩn Công ước này và thành viên chưa phê chuẩn công ước, trong vòng 01 năm
sau khi kết thúc thời hạn 10 năm nói trong khoản trên mà không thực hiện quyền
bãi ước quy định tại Điều này, thì sẽ bị ràng buộc trong một thời hạn 10 năm
nữa rồi sau đó mới có thể bãi ước Công ước này mỗi khi kết thúc thời hạn 10 năm
theo những điều kiện quy định tại Điều này.
Điều 12
1. Tổng Giám đốc Văn
phòng Lao động Quốc tế sẽ thông báo cho mọi Thành viên của Tổ chức Lao động
Quốc tế biết mọi trường hợp đăng ký phê chuẩn, gửi tuyên bố và bãi ước mà các
Thành viên đã truyền đạt cho Tổng Giám đốc.
2. Khi thông báo cho
các Thành viên của Tổ chức Lao động Quốc tế về việc đăng ký phê chuẩn của Thành
viên thứ hai, Tổng Giám đốc sẽ lưu ý các Thành viên về thời điểm mà Công ước
bắt đầu có hiệu lực.
Điều 13
Để đăng ký theo Điều
102 của Hiến chương Liên Hợp quốc, Tổng Giám đốc Văn phòng Lao động Quốc tế sẽ
truyền đạt cho Tổng thư ký Liên Hợp quốc đầy đủ mọi chi tiết về việc phê chuẩn,
các tuyên bố và các văn bản về bãi ước đã được đăng ký theo các quy định tại các
Điều trên.
Điều 14
Mỗi khi xét thấy cần
thiết, Hội đồng Quản trị của Văn phòng Lao động Quốc tế sẽ trình một bản báo
cáo về tình hình hoạt động của Công ước này lên Hội nghị toàn thể ILO và sẽ xem
xét có cần đưa vào chương trình nghị sự của Hội nghị toàn thể việc sửa đổi lại
một phần hoặc toàn bộ Công ước này hay không.
Điều 15
1. Nếu Hội nghị toàn
thể thông qua một Công ước mới sửa đổi lại một phần hoặc toàn bộ Công ước này
và nếu Công ước mới không quy định khác thì:
a) mặc dù có những
quy định về việc bãi ước, một Thành viên phê chuẩn một Công ước mới sửa đổi,
thì sẽ đương nhiên dẫn đến sự bãi ước ngay lập tức đối với Công ước này, bất kể
qui định trong Điều 11 bên trên, vào lúc Công ước mới sửa đổi đó bắt đầu có
hiệu lực.
b) kể từ ngày Công
ước mới sửa đổi bắt đầu có hiệu lực, các Thành viên sẽ không tiếp tục phê chuẩn
Công ước này nữa.
2. Trong mọi trường
hợp, Công ước này sẽ giữ nguyên hiệu lực về cả hình thức và nội dung đối với
những Thành viên đã phê chuẩn Công ước này mà chưa phê chuẩn Công ước mới sửa
đổi.
Điều 16
Cả hai bản tiếng Anh
và tiếng Pháp của Công ước này đều có giá trị như nhau.

Organise and Collective Bargaining Convention, 1949 (No. 98)
Convention concerning the Application of the Principles
of the Right to Organise and to Bargain Collectively (Entry into force: 18 Jul
1951)
Preamble
The General
Conference of the International Labour Organisation,
Having been convened
at Geneva by the Governing Body of the International Labour Office, and having
met in its Thirty-second Session on 8 June 1949, and
Having decided upon
the adoption of certain proposals concerning the application of the principles
of the right to organise and to bargain collectively, which is the fourth item
on the agenda of the session, and
Having determined
that these proposals shall take the form of an international Convention,
adopts this first
day of July of the year one thousand nine hundred and forty-nine the following
Convention, which may be cited as the Right to Organise and Collective
Bargaining Convention, 1949:
Article
1
1. Workers shall
enjoy adequate protection against acts of anti-union discrimination in respect
of their employment.
2. Such protection
shall apply more particularly in respect of acts calculated to--
(a) make the
employment of a worker subject to the condition that he shall not join a union
or shall relinquish trade union membership;
(b) cause the
dismissal of or otherwise prejudice a worker by reason of union membership or
because of participation in union activities outside working hours or, with the
consent of the employer, within working hours.
Article
2
1. Workers' and
employers' organisations shall enjoy adequate protection against any acts of
interference by each other or each other's agents or members in their
establishment, functioning or administration.
2. In particular,
acts which are designed to promote the establishment of workers' organisations
under the domination of employers or employers' organisations, or to support
workers' organisations by financial or other means, with the object of placing
such organisations under the control of employers or employers' organisations,
shall be deemed to constitute acts of interference within the meaning of this
Article.
Article
3
Machinery
appropriate to national conditions shall be established, where necessary, for
the purpose of ensuring respect for the right to organise as defined in the
preceding Articles.
Article
4
Measures appropriate
to national conditions shall be taken, where necessary, to encourage and
promote the full development and utilisation of machinery for voluntary
negotiation between employers or employers' organisations and workers'
organisations, with a view to the regulation of terms and conditions of
employment by means of collective agreements.
Article
5
1. The extent to
which the guarantees provided for in this Convention shall apply to the armed
forces and the police shall be determined by national laws or regulations.
2. In accordance
with the principle set forth in paragraph 8 of Article 19 of the Constitution
of the International Labour Organisation the ratification of this Convention by
any Member shall not be deemed to affect any existing law, award, custom or
agreement in virtue of which members of the armed forces or the police enjoy
any right guaranteed by this Convention.
Article
6
This Convention does
not deal with the position of public servants engaged in the administration of
the State, nor shall it be construed as prejudicing their rights or status in
any way.
Article
7
The formal
ratifications of this Convention shall be communicated to the Director-General
of the International Labour Office for registration.
Article
8
1. This Convention
shall be binding only upon those Members of the International Labour
Organisation whose ratifications have been registered with the
Director-General.
2. It shall come
into force twelve months after the date on which the ratifications of two
Members have been registered with the Director-General.
3. Thereafter, this
Convention shall come into force for any Member twelve months after the date on
which its ratification has been registered.
Article
9
1. Declarations
communicated to the Director-General of the International Labour Office in
accordance with paragraph 2 of Article 35 of the Constitution of the International
Labour Organisation shall indicate --
(a) the territories
in respect of which the Member concerned undertakes that the provisions of the
Convention shall be applied without modification;
(b) the territories
in respect of which it undertakes that the provisions of the Convention shall
be applied subject to modifications, together with details of the said
modifications;
(c) the territories
in respect of which the Convention is inapplicable and in such cases the
grounds on which it is inapplicable;
(d) the territories
in respect of which it reserves its decision pending further consideration of
the position.
2. The undertakings
referred to in subparagraphs (a) and (b) of paragraph 1 of this Article shall
be deemed to be an integral part of the ratification and shall have the force
of ratification.
3. Any Member may at
any time by a subsequent declaration cancel in whole or in part any reservation
made in its original declaration in virtue of subparagraph (b), (c) or (d) of
paragraph 1 of this Article.
4. Any Member may,
at any time at which the Convention is subject to denunciation in accordance
with the provisions of Article 11, communicate to the Director-General a
declaration modifying in any other respect the terms of any former declaration
and stating the present position in respect of such territories as it may
specify.
Article
10
1. Declarations
communicated to the Director-General of the International Labour Office in
accordance with paragraph 4 or 5 of Article 35 of the Constitution of the
International Labour Organisation shall indicate whether the provisions of the
Convention will be applied in the territory concerned without modification or
subject to modifications; when the declaration indicates that the provisions of
the Convention will be applied subject to modifications, it shall give details
of the said modifications.
2. The Member,
Members or international authority concerned may at any time by a subsequent
declaration renounce in whole or in part the right to have recourse to any
modification indicated in any former declaration.
3. The Member,
Members or international authority concerned may, at any time at which this
Convention is subject to denunciation in accordance with the provisions of
Article 11, communicate to the Director-General a declaration modifying in any
other respect the terms of any former declaration and stating the present
position in respect of the application of the Convention.
Article
11
1. A Member which
has ratified this Convention may denounce it after the expiration of ten years
from the date on which the Convention first comes into force, by an act
communicated to the Director-General of the International Labour Office for
registration. Such denunciation shall not take effect until one year after the
date on which it is registered.
2. Each Member which
has ratified this Convention and which does not, within the year following the
expiration of the period of ten years mentioned in the preceding paragraph,
exercise the right of denunciation provided for in this Article, will be bound
for another period of ten years and, thereafter, may denounce this Convention
at the expiration of each period of ten years under the terms provided for in
this Article.
Article
12
1. The
Director-General of the International Labour Office shall notify all Members of
the International Labour Organisation of the registration of all ratifications,
declarations and denunciations communicated to him by the Members of the
Organisation.
2. When notifying
the Members of the Organisation of the registration of the second ratification
communicated to him, the Director-General shall draw the attention of the
Members of the Organisation to the date upon which the Convention will come
into force.
Article
13
The Director-General
of the International Labour Office shall communicate to the Secretary-General
of the United Nations for registration in accordance with Article 102 of the
Charter of the United Nations full particulars of all ratifications,
declarations and acts of denunciation registered by him in accordance with the
provisions of the preceding articles.
Article
14
At such times as it
may consider necessary the Governing Body of the International Labour Office
shall present to the General Conference a report on the working of this
Convention and shall examine the desirability of placing on the agenda of the
Conference the question of its revision in whole or in part.
Article
15
1. Should the
Conference adopt a new Convention revising this Convention in whole or in part,
then, unless the new Convention otherwise provides,
(a) the ratification
by a Member of the new revising Convention shall ipso jure involve the
immediate denunciation of this Convention, notwithstanding the provisions of
Article 11 above, if and when the new revising Convention shall have come into
force;
(b) as from the date
when the new revising Convention comes into force, this Convention shall cease
to be open to ratification by the Members.
2. This Convention
shall in any case remain in force in its actual form and content for those
Members which have ratified it but have not ratified the revising Convention.
Article
16
The English and
French versions of the text of this Convention are equally authoritative.
